The 2020 winter sales ended on Tuesday, February 4, 2020. The promotions started on the 2nd Wednesday of January, which fell before the date of the 12th, i.e. Wednesday 8January 2020, at 8 am. If the 2nd Wednesday of the month had fallen after the date of the 12th, then the start date for the winter sales would have been one week earlier. For the first time, the winter sales calendar was thus spread out over 4 weeksinstead of 6 before the reform. Please note that, by way of derogation, different dates are applied in certain territories (excluding distance selling). For metropolitan France, this is the case in Meurthe-et-Moselle (54), Meuse (55), Moselle (57) and Vosges (88). Certain overseas departments also benefit from derogation dates.

Summer sales 2020

As provided for in the Commercial Code, the summer sales start on the last Wednesday of June. Except when that day is after the 28th of the month. The start date of the summer sales is then moved to the penultimate Wednesday in June. The next summer sales will begin on Wednesday, 25 June 2020, at 8 a.m. and will end on Tuesday, 22 July 2020 in most departments.Many derogations exist depending on the area (see table below).

Date of sales in France: what does the law say?

The Pact law, passed in September 2018, provides for more concentrated balances over time, increasing from 6 weeks to 4 weeks per sales period. The reform comes into effect for the 2020 winter sales. 

Another change: the period of floating balances was abolished in January 2015. Introduced in 2009, this practice allowed merchants a freely organized two-week sales period. The latter would not have been economically efficient and would have caused further confusion for consumers, according to the rapporteurs of the amendment deleting the enacting terms.

Balances meet three characteristics, according to the Ministry of Economy. First of all, they are accompanied or preceded by advertising. Then, they include an announcement of a price reduction, which can go as far as resale at a loss, within the limit of the stock to be sold. Finally, they are practiced during a fixed period, as provided for in the Commercial Code.

Sale items must clearly display a price reduction.

There is no way for a merchant to restock during these business operations, unlike promotions. Merchants can only sell items that have been paid for and offered for at least one month on the sale start date.

During sales, the articles concerned must clearly display a price reduction. These advertisements during sales must not constitute an unfair commercial practice within the meaning of Article L.121-1 of the Consumer Code, explains the DGCCRF. For example, merchants must not make claims that are likely to mislead the consumer about the price and how it is calculated.

Items purchased on sale benefit from the same guarantees as other items. Limitations on guarantees on balances are illegal, even the DGCCRF points out. In the event of a hidden defect, the seller is obliged to replace the article or reimburse it. In the event of a lack of conformity identified within two years of purchase, the seller must repair, replace or refund. In other cases, the merchant is not obliged to refund or exchange the product, unless it is advertised in the store or on the sales receipt. 

To sum up, the Directorate-General for Competition, Consumer Affairs and Fraud Prevention points out that :

  • During these six weeks of sales, merchants do not have to restock their stalls with new products on sale.
  • Artificially inflating discounts by raising prices just prior to the launch of the event is prohibited.
  • The seller must clearly indicate the discount on the label and on the items on sale or not. 
  • The mention neither taken back nor exchanged is forbidden by law.

Outside sales periods, merchants may offer promotional operations, but are not allowed to sell at a loss or use the term balance(s).

As for the dates of the balances, why do they vary from one department to another? Because some people have asked for waivers. In winter, the four departments of Lorraine wish to start earlier so as not to fall behind the nearby Luxembourg, where sales start earlier than in France. Overseas departments and collectivities, on the other hand, follow the seasons, which are not the same as in mainland France. As for Corsica and the Alpes-Maritimes, they prefer, in the summer, to align the dates of their sales with periods of high tourist numbers.
